These Terms of Service ("Terms") govern your access to and use of RoadTripAI (the "Service"), including any associated websites, mobile applications, APIs, and content (collectively, the "Platform"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, our Community Guidelines, and our Safety Disclaimer. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and that you have authority to enter into these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must provide accurate information and keep it up to date.
• You may not impersonate any person, organisation, or brand.
• We may suspend or terminate accounts that violate these Terms, our Community Guidelines, or applicable law.

3. The Service

RoadTripAI helps you discover, plan, save, and share road trip itineraries. Routes may be authored by other users, generated by AI tools, or curated by RoadTripAI. The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, accurate, complete, current, or fit for any particular purpose.

Travel & Safety Disclaimer

RoadTripAI is a discovery and planning platform. We do not operate, inspect, certify, or guarantee any road, route, trail, ferry, border crossing, charging station, fuel station, lodging, or destination. Routes, photos, descriptions, durations, distances, and tips are provided for inspiration and may be created, edited, or rated by community users, AI tools, or third parties.

You acknowledge and agree that:

• You are solely responsible for verifying current road conditions, weather, closures, traffic laws, local regulations, border requirements, vehicle restrictions, insurance coverage, fuel and charging availability, and your own physical and mental fitness to travel before departing.
• RoadTripAI is not a navigation app. Links to Google Maps, Waze, Apple Maps, or other third-party services are provided for convenience only. We do not control and are not responsible for their accuracy, availability, routing decisions, ETAs, or any failures.
• You must obey all traffic laws, posted signs, speed limits, and local regulations at all times.
• You must not follow any route that is unsafe, illegal, private, restricted, closed, gated, off-limits, or that you are not legally or physically qualified to travel.
• Cycling, motorcycle, off-road, mountain, winter, desert, coastal, alpine, and remote routes carry additional and sometimes severe risks (including weather exposure, isolation, mechanical failure, wildlife, altitude, and lack of cellular coverage). Plan accordingly, carry appropriate equipment, inform someone of your plans, and never travel beyond your skill level.
• Distances, durations, and difficulty ratings are estimates and may not reflect real conditions, your vehicle, traffic, weather, or driver experience.
• RoadTripAI is not a substitute for professional travel, medical, legal, mechanical, or safety advice.

To the maximum extent permitted by law, RoadTripAI, its officers, employees, contributors, and licensors disclaim all liability for accidents, injuries, deaths, illnesses, losses, damages, fines, citations, vehicle damage, delays, route errors, road closures, weather events, third-party service failures, or any consequence arising from your use of the platform or any travel decisions you make. You travel at your own risk.

4. User-Generated Content

You retain ownership of content you submit ("User Content"). You grant RoadTripAI a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify, adapt, publish, translate, distribute, and display your User Content for the purpose of operating, improving, marketing, and providing the Service. This licence ends when you delete the User Content, except where retention is required by law or for backup, audit, or legal-hold purposes.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any law or third-party right. See our User-Generated Content Policy and Acceptable Use Policy.

5. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes (without limitation): unlawful activity; fraud or misrepresentation; spam; harassment; hate speech; sharing dangerous, illegal, restricted, or fabricated routes; attempts to interfere with security; scraping; circumventing rate limits or paywalls; and any use that infringes intellectual property or privacy rights.

6. Premium & Creator Plans

Paid plans are governed by our Premium Subscription Terms, Creator Terms, and Refund Policy. Payment, billing, tax, cancellations, and refunds are handled by our merchant of record, Paddle.com, and are also governed by Paddle's Buyer Terms. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Intellectual Property

The Service, including its software, design, branding, text (other than User Content), trademarks, and logos, is owned by RoadTripAI or its licensors and is protected by intellectual property law. You receive a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes (or commercial purposes consistent with a Creator plan).

8. Third-Party Services

The Service may link to or integrate third-party services (Google Maps, Waze, Apple Maps, weather, payments, analytics, social platforms). RoadTripAI is not responsible for those services, their availability, accuracy, content, or practices. Your use of them is governed by their own terms.

9. AI Outputs

AI-generated itineraries, descriptions, and recommendations are produced by automated systems and may be inaccurate, outdated, or unsuitable for your circumstances. You are responsible for reviewing AI outputs before relying on them. Outputs may not be unique to you. We do not guarantee that AI outputs are free of bias, error, or omission.

10. Termination & Suspension

We may suspend or terminate your access at any time for material breach of these Terms, non-payment, suspected fraud or abuse, security risk, or repeated violations of our policies. You may close your account at any time via the profile settings. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, and indemnification) will survive.

11. Disclaimers & Limitation of Liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.

To the fullest extent permitted by law, RoadTripAI's aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid to RoadTripAI in the 12 months preceding the claim or (b) USD 100. RoadTripAI is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or substitute services, even if advised of the possibility. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the greatest extent permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless RoadTripAI and its affiliates, officers, employees, and contributors from any claim, damage, liability, cost, or expense (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service, email, or a re-acceptance prompt. Continued use after the effective date constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which RoadTripAI is established, without regard to conflict-of-laws principles. The competent courts of that jurisdiction will have exclusive jurisdiction, except where mandatory consumer protection law provides otherwise.
